Mandatory rights

These terms govern sales through northseacreations.be. Mandatory Belgian and European consumer protection rules always take precedence; nothing here limits your statutory consumer rights.

1. Seller

North Sea Creations is the webshop of North Sea Works & Services, a sole proprietorship, Doktersweg 12 bus G001, 8660 De Panne, Belgium. Enterprise number 1041.273.917; VAT BE 1041.273.917. Email northsea.creations@outlook.com; telephone +32 470 89 61 82.

2. Customers

A consumer is a natural person buying for purposes outside their business, trade, craft or profession. A business customer buys for professional purposes. The purpose of the purchase determines this status; a company name or VAT number in a profile does not automatically make the purchase a business purchase.

3. Scope

These terms apply to consumer and business orders through our webshop. For custom work outside the webshop, they apply only if expressly supplied with the quotation or confirmation and accepted. Mandatory consumer law takes precedence. For business customers, separately agreed written quotation or contract terms take precedence where expressly agreed. We deliver within Belgium only.

4. Offers, prices and images

Consumer prices are in euros and include VAT. Shipping is shown separately before payment. Products priced on request cannot be paid for online and are confirmed personally. Product photographs represent the product; a labelled style example or AI visualisation illustrates a design and is not a photograph of a delivered item.

5. Handmade variations

Wood grain, natural colour and texture, the position of natural features, engraving and minor 3D-print manufacturing details may vary slightly. Normal minor variations alone are not defects. The product must still match its description, agreed personalisation, selected finish, essential characteristics and reasonable expectations. Damage, incorrect products, defective finishing and other non-conformity remain covered by section 11.

6. Obvious errors

We are not bound to fulfil an order based on an obvious, objectively recognisable price, typing or technical error that an average customer should reasonably recognise, such as €0.79 instead of €79.95. We do not use this rule to cancel ordinary orders merely because a price is less favourable to us. If payment has been made, we notify you immediately and refund the full amount without administration charges.

7. Ordering and contract

Choose a product and its options. Before payment, the overview shows the product, quantity, personalisation, shipping method and costs, and total price, with links to terms, returns and privacy. “Order and pay” places an order with an obligation to pay. Mollie processes payment by Bancontact, Visa or Mastercard. After successful payment, we electronically confirm your order with an order number; the contract is then final. We may refuse or cancel only for an objective reason: the product cannot reasonably be supplied, an obvious price/system error, technically impossible personalisation, clearly unlawful content, suspected fraud/abuse or another objectively justified reason. If a paid order cannot be fulfilled, we inform you and refund the full amount without undue delay.

8. Payment

Online payment is through Mollie using Bancontact, Visa or Mastercard. For personalised custom work outside the online checkout, a 50% deposit is due after design approval; production starts after receipt. The balance is due before delivery or on collection. For small personalised orders below €100, full payment at ordering may be requested.

9. Your photos and files

When supplying photographs, logos, trademarks, illustrations, text, names, designs or other files, you confirm that you have the rights or permission required for us to process them for your order. We do not actively legally check each image. We may refuse content where there are reasonable grounds to believe it is unlawful, infringes copyright/trademark or other rights, is offensive/discriminatory, incites violence or contains prohibited material, or is technically unsuitable. Files are used to fulfil your order; other use requires a lawful basis or your permission, as explained in our privacy policy.

10. Personalisation and withdrawal

Consumers have a statutory 14-day right of withdrawal for ordinary products, including products we manufacture ourselves. The statutory exception may apply to goods made to your specifications or clearly personalised, such as your own name/text, a figurine/engraving from your photo, your logo or custom design (Belgian Code of Economic Law, article VI.53, 3°). We disclose the applicable exception on the product page and before ordering. Selecting a coastal town from our fixed list is not personalisation. For ordinary withdrawal, you pay direct return costs. We refund within 14 days of notification, including original delivery costs up to the cheapest standard delivery rate, subject to receiving the goods or earlier evidence of dispatch. You may use the online withdrawal function, model form, or an unambiguous email or letter. See the returns policy.

11. Statutory guarantee

Consumers have a two-year statutory conformity guarantee for defects existing at delivery, including personalised goods. We never shorten it. Report wrong, damaged or non-conforming goods as soon as possible, preferably with a photograph. We arrange repair or replacement, or if these are not possible, a price reduction or refund in accordance with the law. Return costs for non-conforming goods are not yours. The guarantee and withdrawal right are separate; both remain applicable where provided by law.

12. Processing, delivery and shipping

For standard products, workshop processing/production takes 1–4 working days (Monday–Friday), followed by 1–2 working days carrier transport for home or pickup delivery. Orders before 14:00 Belgian time on a working day count that day as the first processing day; otherwise processing starts the next working day. A different period stated for a product or in the confirmation applies. Delivery is in any event within 30 days; if this is not possible, we notify you and you may cancel free of charge. 13. Ownership and risk

To the extent permitted by law, goods remain our property until the full price is paid. For consumers, risk of loss or damage passes only when you or a person you designate, other than the carrier, physically receives the goods.

14. Complaints

Contact northsea.creations@outlook.com or +32 470 89 61 82 and quote your order number. We acknowledge as soon as possible, aim for a substantive initial response within five working days and resolution within 14 calendar days. If further investigation is necessary, we explain the anticipated further handling. These service targets do not restrict your rights or cause you to lose rights if you complain later.

15. Liability and force majeure

Liability is governed by law. Consumer liability rights are not additionally contractually limited; statutory guarantee and withdrawal rights remain. For business customers, indirect losses such as lost profits or turnover are excluded only to the extent legally permitted. No exclusion applies to intent, gross fault, bodily injury or liability that cannot legally be limited. Force majeure means an unforeseeable/unavoidable circumstance beyond reasonable control, such as major transport disruption, power/infrastructure failure, fire, natural disaster, government action or exceptional disruption at essential suppliers/payment/IT providers. Ordinary workload or poor planning is not force majeure. We notify you promptly and resume as soon as possible. Consumer rights, including termination for late delivery, remain.

16. Personal data

See the privacy policy. Fiscal invoices, accounting documents and necessary order/payment evidence are retained for the statutory ten-year period, calculated from 1 January following the relevant year. Other personal information is retained according to its purpose; a separate withdrawal dossier is retained for seven years after receipt.

17. Law and courts

Belgian law applies. For consumers, this does not remove protection under mandatory rules of the law that would otherwise apply. Disputes go to the court competent under applicable statutory jurisdiction rules. For business customers, the courts of our establishment are in principle competent only insofar as validly agreed and not overridden by mandatory law.

18. Versions

The version applicable when you order governs your purchase. Later changes do not rewrite existing confirmations. Your statutory rights remain protected. See the returns, withdrawal, shipping, privacy and contact pages.
